Should you make a holiday back pay claim?

If you receive payments on top of your basic wage, such as overtime, commission, shift premiums or other payments, you may now be entitled to receive such payments with your holiday pay. You may also be eligible to receive back pay on your holiday going back several years.

The principle behind this is that employees should not be deterred from taking holiday by receiving lower pay while they are off work.

Does my employer have to pay me holiday pay?

Depending on your contract, location (and whether you have one), it is extremely likely that your employer will have to pay you holiday pay. For most workers, you are legally entitled to 5.6 weeks’ paid holiday a year.

Can you sue a company for not paying holiday pay?

Yes, it is possible to sue a company for not paying an employee their entitled holiday pay. If an employee has been deterred from taking holiday by receiving lower pay whilst off work, or for any other reason, our specialist employment lawyers may be able to help.

How Far Back Can You Claim Holiday Pay When Leaving a Job?

You need to act quickly - the deadline for taking action is usually 3 months less one day from when your employer should have paid you the money you’re owed. This is often the same date as your last pay date, but it’s a good idea to check the date your employer should have paid you what you’re owed, in case it was due on an earlier date.
