New tribunal penalties against employers to be introduced


We reported on these new employer penalties in our 9 October 2013 blog and can confirm they are being  introduced on 6 April 2014.  As previously reported, the penalty will range from £100 to £5,000 depending on the value of the Claimant’s award and the aggravating features  of the employer’s breach of the Claimant’s rights.

We don’t know as yet the extent to which tribunals will exercise their discretion to award this penalty but watch out for Claimant representatives using it in order to leverage up any settlement for their clients.
