New compromise agreements


Likely to be in force from summer 2013, compromise agreements are to be renamed ‘settlement agreements’ and Acas has prepared a draft code of practice on settlement agreements which intends to explain the change in the law relating to ‘without prejudice’ discussions.  The change in the law is intended to allow ‘greater flexibility in the use of confidential discussions’  and template agreements will be published. The suggestion of guideline tariffs for settlements has been dropped.  Closing date for consultation is 9 April 2013.
