What is a prenuptial agreement?
Prenuptial agreements are legal contracts entered into by couples prior to getting married. These agreements outline the financial and property rights of each spouse in the event of a divorce or separation. While the family courts retain jurisdiction to decide the financial arrangements on separation, prenuptial agreements that follow the guidance arising from case law are likely to have a strong influence on the court's decision.
Difference between prenuptial agreements & postnuptial agreements
Prenuptial agreements are similar to postnuptial agreements, but they are entered into before a couple is married.
Prenuptial agreements are often utilised to protect the assets of one spouse who has significantly accrued significant wealth prior to the marriage - this increasingly includes clients entering into a second marriage who may wish to "ring-fence" certain assets for the benefit of children from their previous marriage.
Postnuptial agreements are entered into after marriage has taken place. In some cases, they mirror the terms of existing pre-nuptial agreements and provide a further record of the parties original intentions but they can also be used to record changes to existing financial agreements in the event of a change In circumstances.
