Changing terms and conditions of employment


Undertakings (Protection of Employment) Regulations 2006 you may be unable to change the terms and conditions of employment at all even with the employees’ agreement. This puts you at risk of new agreed restrictive covenants not being enforceable against a departing employee.

You will need to be aware of whether any changes are likely to give rise to claims and, if so how best to act.
