If there is a Will then in most cases it will be necessary to obtain a legal document called the ‘Grant of Probate’ that allows an executor to distribute assets in accordance with the wishes set out in the Will.
If there is no Will it may be necessary to obtain a ‘Grant of Letters of Administration’ that allows the next of kin to distribute the assets in accordance with the laws of intestacy.
