Contested probate
Is a Will valid? Is the signature correct? What does it mean? Does it have more
than one meaning? Is it impossible to administer? Are bequests no longer possible?
Does the Will give away assets that are not owned by the testator? Was the testator
of sound mind? Has there been coercion or undue influence? Was it made in unusual
circumstances? Does the estate have lots of debts? Was the testator in trouble or
have business problems? Is the Will a DIY job or made from a kit or downloaded from
the internet? Does the Will or intestacy fail to make adequate financial provision
for spouses, former spouses, children, cohabitees or dependants? Are ex-spouses
challenging the Will? Are current spouses or children disinherited? Is it a mutual
Will? Are the executors dealing with it? Are the executors dealing with it properly?
Are people saying that the Will is wrong and threatening to sue? Has a Will gone
missing? Is there a Codicil? Did the Will revoke earlier Wills? Is there a partial
intestacy? Are the family in dispute? Are you an Executor? Are you a beneficiary
or think that you should be? Has there been skulduggery?
These are just a few of the problems that can occur when a person dies. That person
may be a spouse, former spouse, cohabitant, relative or loved one or perhaps a close
friend or business colleague. You may find yourself as the executor of a Will that
is being challenged by others. You may find yourself the unwitting defendant to
legal proceedings. You may be someone for whom the testator might properly have
provided for, but did not. In any event you are likely to be upset and in need of
impartial and professional advice, delivered sensitively and discreetly.
